What Are Breckenridge's Short-Term Rental Rules in 2026?

Breckenridge still has real opportunity for buyers who want a mountain property they can rent when they're not using it, but the opportunity depends entirely on which of the town's four short-term rental zones a property falls into.

Breckenridge divides the town into four zones for STR purposes. The Resort Zone sits at the base of the lifts and consists primarily of condos, with no restriction on new licenses. Zone 1 is adjacent to the Resort Zone and includes condos, townhomes, and some single-family homes, with licenses still generally available. Zone 2 is the downtown core, and Zone 3 covers the rest of incorporated Breckenridge, primarily single-family neighborhoods. Zones 2 and 3 are capped, and Zone 3 in particular has effectively no new licenses available, with a waitlist that can run years.

One detail that catches buyers off guard: an STR license is tied to the owner, not the property. It doesn't transfer at closing. If a listing advertises strong rental income history, that reflects the previous owner's license and business, not a guarantee the same is available to a new buyer. Confirming a property's actual zone and license status is a required step, not an assumption to make from the listing.

That doesn't mean single-family buyers are out of options; it means the strategy changes. Most single-family homes fall in Zone 3, where new nightly-rental licenses aren't available. But there's still a real path to revenue: renting the property for stays of 31 days or longer, which falls outside the short-term rental license requirement entirely.

This works particularly well for second-home buyers, since most owners only use their Breckenridge property 8 to 10 weeks a year. A longer-stay rental strategy fills the rest of the calendar, generates income to offset carrying costs, and puts less wear on the home than a rotating string of short-term guests.

The right approach always starts with understanding what a buyer actually wants: full-time personal use, a rental income strategy, or something in between, and matching that to a property and zone that can deliver it.
